The Boone County mother charged with child neglect that deputies believe led to the death of her 14-year-old daughter is making another bid for bond in hopes of getting out of jail pending trial.
Julie Ann Stone Miller, 49, of Morrisvale is charged with child neglect causing death after Kyneddi Miller was found dead on a bathroom floor, "emaciated to a skeletal state" on April 17.
In a motion filed late last month, Miller's attorneys, Ronald Walters, Jr. and Beverly Hall, argue that Miller's $250,000 cash-only bond is substantially higher than that of her parents, who are charged with the same crime. Donna and Jerry Stone have been released on $25,000 property/surety bonds since their arrestin May.
They also allege Miller did not live in the same home as Kyneddi and said Kyneddi lived with her grandparents.
"In consideration of the strength of the state's case, Ms. Miller did not live in the same house as minor child. In fact, the minor child lived in the home of Donna and Jerry Stone; however Ms. Miller's bond remains significantly higher than the individuals who lived in the same household as the minor child," the motion said. "There are various issues with the information presented thus far from the state as to Ms. Miller's culpability in this matter."
At a bond hearing in May, Judge Stacy Nowicki-Eldridge ruled that Miller's bond was reasonable and said if Miller did post bond, she would have to remain on home confinement.
Boone County Prosecuting Attorney Dan Holstein went into graphic details during the previous hearing about Kyneddi's condition, sharing photos and saying it compared to starvation images from the Holocaust. He said she laid on the foam pad in the bathroom, unable to move for four to five days. He said she was malnourished and was not fed or given medical care.
“This child was emaciated to a skeletal state and that is not an exaggeration," Holstein said to the court. "We’ve all seen Holocaust pictures. These pictures in my mind are worse than that.”
Holstein said the prosecution has a recorded jail phone call where Miller allegedly told her parents that Kyneddi "wanted to die" and that she does what Kyneddi wants.
The new bond motion said Miller maintains her innocence of all charges in the matter.
A hearing is set for 1:00 p.m. on Friday.
