A Kanawha County man was arrested Monday after two children in his care were found unattended in a roadway, court records said.
Nicholas Ray Dingess, 27, of Charleston, has been charged with child neglect, according to a criminal complaint filed in Kanawha County Magistrate Court.
The complaint said Marmet police conducted a well-being check Monday afternoon at a home along California Avenue after neighbors spotted two small children in the roadway.
Officers said a 22-month-old child was “wearing what appeared to be a sagging diaper and no shoes” while a 3-year-old child was found wearing socks and long pants.
Police said after a few minutes of investigating, Dingess came looking for the boys, claiming the children left an apartment while he was showering.
The complaint said the apartment was searched for additional children and the shower area was dry. Investigators said Dingess was fully dressed and completely dry when he came outside the apartment.
Court records said Child Protective Services has been informed of the situation.
Dingess is being held at South Central Regional Jail on a $3,000 bail.
